Terms of service

These terms are an agreement between you and Rocky Mountain Analytics ("we," "us," "our"), a sole proprietorship operated by Keith Twohig, based in Calgary, Alberta, Canada. They govern your use of our website and our analytics service. By using the website, signing up, or using the service, you agree to these terms. If you don't agree, please don't use the service.

The service

Rocky Mountain Analytics is a done-for-you social media analytics service. We help you connect your accounts — Instagram, Google Business Profile, and TikTok — and we build and maintain a private dashboard that shows how they're performing, updated daily. The platforms we support and the metrics shown may change over time.

Your accounts and your responsibilities

• You must have the right and authority to connect any social account you connect, and to let us access its analytics on your behalf.
• You're responsible for keeping your connections active and for keeping your portal sign-in secure.
• You agree to provide accurate information and to use the service lawfully and only for your own business.

Our access

Our access to your connected platforms is read-only. We can read your analytics, but we can't post, like, comment, message, or make any changes on your behalf.

Fees and billing

• The standard plan is $49 CAD per month. There is no setup fee.
• New subscriptions start with a 14-day free trial. A payment method is required to start the trial; billing begins when the trial ends unless you cancel before then.
• The monthly fee is billed in advance. Prices don't currently include sales tax — if we're required to collect GST/HST in the future, it will be added and we'll give you notice first.
• Payments are processed by Stripe. We don't store your card details ourselves.
• Fees may change; we'll give you notice before a change affects you.

Cancellation and refunds

The subscription is month-to-month with no contract. You can cancel any time — from your account or by emailing us — and cancellation takes effect at the end of your current billing period. If you cancel during your free trial, you won't be charged.

Your data

How we handle your data is described in our Privacy policy. In short: your data is stored securely in Canada, isolated from other customers, and — if you cancel — retained for 30 days and then deleted.

Acceptable use

You agree not to misuse the service — including attempting to access other customers' data, disrupt or reverse-engineer the service, or use it for anything unlawful.

Service availability

We work to keep your dashboard accurate and updated daily, but we don't guarantee the service will always be uninterrupted or error-free. Social platforms can change or restrict their data without notice, which may affect what we can show.

Disclaimers

The service is provided "as is." The analytics are for informational purposes and are not professional, marketing, financial, or legal advice, and we don't guarantee any particular business result. To the fullest extent permitted by law, we disclaim warranties not expressly stated here.

Limitation of liability

To the fullest extent permitted by law, Rocky Mountain Analytics is not liable for any indirect, incidental, or consequential damages, and our total liability for any claim relating to the service is limited to the fees you paid us in the three months before the claim.

Termination

You can stop using the service at any time by cancelling. We may suspend or end the service if you breach these terms or don't pay, or if we stop offering the service, in which case we'll give you reasonable notice where we can.

Changes to these terms

We may update these terms from time to time. When we make material changes, we'll update the date above and, where appropriate, let you know. Continuing to use the service means you accept the updated terms.

Governing law

These terms are governed by the laws of the Province of Alberta and the federal laws of Canada that apply there. Any disputes will be handled by the courts located in Alberta.
